§ 18-69. Preliminary resolution to declare special assessments or MSBU.

  • (a)

    When the board decides to make any public improvement authorized by section 18-66 and defray the whole or any part of the cost thereof by special assessment or establishment of a MSBU, the board shall so declare by resolution stating the nature of the proposed improvement, designating the road(s) to be improved, or the parcels to be benefited, and stating the portion of the cost to be paid by the assessment. The resolution shall also designate the lands upon which the assessments shall be levied and in describing said lands, it shall be sufficient to describe them as "all lots and lands adjoining and contiguous or bounding and abutting upon such improvements specially benefited by the assessment hereinafter provided for." The resolution shall also state the total estimated cost of the improvement.

    (b)

    The resolution adopted pursuant to subsection (a) shall be recorded in the public records of the county immediately after its adoption.

    (c)

    The board of county commissioners shall cause to be published once a week for a period of two (2) weeks in a newspaper of general circulation published in the county, a notice stating that at a regular meeting of the board on a certain day and hour not earlier than fifteen (15) days from the first publication, the board will hear objections of all interested persons to the adoption of the resolution provided for in subsection (d).

    (d)

    At the time designated in the notice or to which an adjournment may be taken, the board of county commissioners shall receive any objections of interested persons and may then or thereafter adopt such resolution with such amendments, if any, as may be desired by the board and which do not change the location of the improvement or increase the probable cost thereof.

    (e)

    Following the recording of the resolution, the County Manager or designee will commence construction of the project.
